Procedural directions supporting the 500-page limit now available

The procedural direction amendments to support the new 500-page limit are now available to provide tribunal users an overview of the changes.

The 500-page limit will introduce a limit of 500 pages to supporting documents filed with certain initiating applications and replies. Anyone wishing to submit more than 500 pages of supporting material must apply to the Commission and explain how it relates to the real issues in dispute between the parties.

The changes will help the Commission meet its statutory mandate to deal with the real issues in a dispute justly, quickly, cost effectively and with little formality. By focusing the parties’ attention on the matters that are truly in dispute, the amendments will streamline the resolution of dispute proceedings by reducing the volume of unnecessary material, including documents irrelevant to the real issues in dispute and document duplicates.

This will benefit injured claimants and workers by reducing process trauma while also strengthening the Commission’s approach to cyber security and privacy.

To enable the new rule, PD PIC 3 has been revised to include a reference to the new rule and will commence later this year. The new PD PIC 12 prescribes the 500-page limit and the lodgment of additional documents and will not commence until the new rule commences, anticipated to be in late 2024 or early 2025.
