This bulletin outlines:

The Commission has revised its suite of Practice Directions. The Practice Directions provide guidance on practice and procedure before the Commission.

A full list of the Commission’s updated and new Practice Directions is as follows:

  • Practice Direction No 1: Determination of matters ‘on the papers’
  • Practice Direction No 2: Adjournment of proceedings
  • Practice Direction No 3: Information, documents and other evidence
  • Practice Direction No 4: Correction of “obvious error”
  • Practice Direction No 5: Question of law
  • Practice Direction No 6: Appeal against a decision of an Arbitrator
  • Practice Direction No 7A: Directions for production (NEW)
  • Practice Direction No 7B: Summons to attend (NEW)
  • Practice Direction No 8: Notices for production
  • Practice Direction No 9: Applications to admit late documents
  • Practice Direction No 10: Interim payment directions for weekly payments of compensation or medical expenses compensation
  • Practice Direction No 12: Joinder of other parties and disputes

An updated Practice Direction No 11: Process for Resolution of Permanent Impairment Disputes Lodged with the Commission will be published to coincide with the commencement of the relevant 2018 workers compensation legislative amendments.

The changes to the Practice Directions necessitated change to a number of Commission forms. A full list of the Commission’s updated and new forms is as follows:

  • Form 6: Application to Resolve a Workplace Injury Management Dispute
  • Form 6B: Reply to Application to Resolve a Workplace Injury Management Dispute (NEW)
  • Form 8A: Application for leave to serve a ‘Direction for Production’ or ‘Summons to Attend’ outside the state of New South Wales
  • Form 13: Application for Leave to Refer a Question of Law
  • Form 13A: Response to Application for Leave to Refer a Question of Law
  • Template: Notice for Production (NEW)
