Legislation
The Personal Injury Commission was established by the Personal Injury Commission Act 2020. This Act provides for the objects and functions of the Commission, as well as determining how proceedings are conducted and determined.

Motor Accidents Division
Acts
Proceedings in the Motor Accidents Division are determined under two separate Acts, depending on the date of the accident. For accidents that occurred on or before 30 November 2017, the Motor Accidents Compensation Act 1999 applies.
For accidents that occurred on or after 1 December 2017, the Motor Accident Injuries Act 2017 applies.
Regulations
There are two Regulations made under each Act:
- The Motor Accidents Compensation Regulation 2020 is made under the Motor Accidents Compensation Act 1999 and applies to claims made under that Act.
- The Motor Accident Injuries Regulation 2017 is made under the Motor Accident Injuries Act 2017 and applies to claims made under that Act.
Motor Accident and Workers Compensation Amendment Act 2022
The Motor Accident and Workers Compensation Amendment Act 2022 (Act) received assent on 16 June 2022.
The Act introduces a number of amendments to the motor accidents and workers compensation enabling legislation, as well as the Personal Injury Commission Act 2020.

Motor Accident Injuries Amendment Act 2022
The Motor Accident Injuries Amendment Act 2022 (MAI amending Act) received assent on 28 November 2022.
The MAI amending Act introduces a number of amendments to the Motor Accident Injuries Act 2017 and the Motor Accident Injuries Regulation 2017.
